ADMINISTRATIVE-LEGAL REGIME OF MOBILIZATION CAPACITIES IN UKRAINE

The article presents a comprehensive doctrinal analysis of the legal nature of mobilization capacities as a structurally significant component of the state’s defense and mobilization system. It substantiates that mobilization capacities constitute a specific object of administrative and legal regulation, as they are established in peacetime with the explicit purpose of ensuring the functioning of the state, its economy, and critical infrastructure during a special period. Their legal status is determined not solely by their economic or production characteristics, but primarily by their public-law function aimed at safeguarding national security and defense capability.
The study examines the regulatory framework governing the establishment, accounting, preservation, transfer, and use of mobilization capacities. Particular attention is paid to the specific legal restrictions imposed on such capacities, including the prohibition of privatization and the limitations on their disposal, even in cases of liquidation of enterprises. It is argued that these restrictions reflect the priority of public interest over private property rights in the sphere of national security and are implemented through a centralized system of public administration.
The administrative and legal regime of mobilization capacities is characterized by imperative regulation, enhanced state supervision, and a clearly defined distribution of powers among executive authorities and other state bodies. The article emphasizes that decisions concerning the transfer or reallocation of mobilization capacities must be adopted within a strictly regulated procedural framework determined by the Cabinet of Ministers of Ukraine. This confirms the special legal status of mobilization capacities as objects subject to a regime of heightened public control.
On the basis of the conducted analysis, the necessity of further improvement of mobilization legislation is substantiated. In particular, attention is drawn to the need for clearer procedural standards, improved coordination between mobilization and commercial law norms, digitalization of accounting systems, and strengthening institutional guarantees of legality and transparency in the management of mobilization capacities. The enhancement of the administrative and legal framework in this sphere is considered a prerequisite for increasing the overall effectiveness of the state’s mobilization preparedness in conditions of armed aggression and prolonged special legal regimes.
