REGULATION OF RENEWABLE ENERGY IN UKRAINE AS AN INDICATOR OF THE PLAN FOR THE UKRAINE FACILITY

Abstract

The article examines the specific features of the legal regulation of renewable energy in Ukraine in the context of implementing the Ukraine Facility Plan. The purpose of the study is to provide a comprehensive characterization and assessment of the legal regulation of the development of renewable energy in Ukraine, as well as to analyse the degree of fulfilment of the obligations defined by the Ukraine Facility Plan, taking into account compliance with the EU energy acquis and the impact of implemented reforms on the formation of a market-based model for supporting renewable energy sources. The emphasis is on the introduction of a market concept of state support for renewable electricity producers and on the development of the regulatory framework for conducting auctions based on the market premium mechanism. The article analyses documents adopted by the Government of Ukraine, including amendments to the Resolutions of the Cabinet of Ministers of Ukraine dated 23 May 2018 No. 420 and 27 December 2019 No. 1175, as well as Order No. 612-r dated 25 June 2025 approving the Roadmap for Separating the Renewable Energy Surcharge from Transmission Tariff. It is determined that the implementation of the measures provided for in the Ukraine Facility Plan is aimed at ensuring transparency, predictability and competitiveness in the field of renewable energy, as well as at harmonizing Ukrainian energy legislation with the norms of the EU acquis, in particular Directive 2018/2001/EU (RED II). The study provides an assessment of the overall status of implementation of European integration commitments in the energy sector and outlines areas for further work, as set out in the European Commission's Report on Ukraine's progress under the 2025 Enlargement Package. It concludes that the introduction of market mechanisms to support renewable energy sources producers is a key step in Ukraine's transition from an administrative to a market-based energy development model and an important component of the European integration process.
