ПРАВОВЕ РЕГУЛЮВАННЯ ПРОЗОРОСТІ ГОСПОДАРСЬКОЇ ДІЯЛЬНОСТІ У ВИДОБУВНИХ ГАЛУЗЯХ УКРАЇНИ

Abstract

The article researches the issues of ensuring openness in the extractive industries, analyzes the national legislation and reports of experts of the Extractive Industries Transparency Initiative. The mining industry is one of the priorities in Ukraine today. State and public control over subsoil and its use is changing, which is reflected in the emergence of new regulations and institutional frameworks for cooperation in this field. Transparency of economic activity, in particular in the extractive industry, is one of the cornerstones of Ukraine's integration into the European Union (EU) through compliance with international standards, rules and regulations in the mining industry, including in the fields of ecology and social protection. In particular, the article analyzes the Law of Ukraine on Ensuring Transparency in Extractive Industries of September 18, 2018. It is a special regulatory act to achieve transparency in the extractive industry, as well as an international standard - the Extractive Industries Transparency Initiative, created to promote openness and accountability in the management of subsoil resources - oil, gas and mineral resources.

The article’s authors state, that the implementation of this special law fully regulates the disclosure of information in the extractive industries, since now in Ukraine there are clear definitions of concepts, limits of regulation of reporting, comprehensive lists of documents and responsible bodies of state power, the list of violations and the scope of liability for entities. The law provides an opportunity to open information about users of natural resources of Ukraine, about environmental and climate impacts from extractive activities in a certain area, about payments made for the benefit of the state, the rest of natural resources in the territory of Ukraine, and therefore there are significant prospects for further development the economic sector of Ukraine.
