ПРАВОВИЙ АНАЛІЗ НОРМАТИВНО-ПРАВОВИХ АКТІВ З ДЕЯКИХ ПИТАНЬ ФУНКЦІОНУВАННЯ МІЖБАНКІВСЬКОГО ВАЛЮТНОГО РИНКУ УКРАЇНИ

Abstract

The study thoroughly examines the legal history of the issue and analyzes a number of legal acts and their norms on the issue of compulsory sale of foreign currency proceeds and some issues of functioning of the interbank foreign exchange market of Ukraine, which made it possible to track the evolution of the legislator's position and regulation these issues and the changes in the corresponding conceptual apparatus that accompanied such evolution.

On the example of many legal acts at the level of law, a number of resolutions of the Government of Ukraine, the Board of the National Bank of Ukraine for various years, the author made a comparative analysis of the norms of legislation that regulated and regulates the issue of compulsory sale of foreign currency receipts and some issues of functioning of the interbank currency. market of Ukraine at different times and its structure.

The author discusses in detail the legal mechanisms for exercising the powers  of banks in the procedure of obligatory sale of part of foreign currency proceeds, as well as some technical issues related to the functioning of the interbank foreign exchange market of Ukraine and related to them having legal consequences.

The author also discussed in detail the issue of compulsory sale of a portion of foreign currency receipts in a special period. The article deals with a number of issues close to the topic, namely the author deals with: the algorithm of actions of banks and their clients from the moment of receipt of foreign exchange earnings to the bank's distribution accounts until the moment of hryvnia equivalent transfer to the current hryvnia accounts of customers after passing the procedure of buying / selling foreign currency on the interbank market Of Ukraine. A number of other problematic issues are considered.
