THE IMPACT OF DIGITALIZATION OF CRIMINAL PROCEEDINGS ON THE IMPLEMENTATION OF THE INSTITUTE OF VICTIM REPRESENTATION

The article provides a comprehensive analysis of the impact of digitalization of criminal proceedings on the implementation of the institution of victim representation. The study examines the theoretical and legal foundations of digital transformation in criminal procedure, as well as the procedural status of the victim and their representative within the framework of modern criminal justice.
Particular attention is paid to the role of digital technologies, including electronic court systems, remote participation in procedural actions, electronic document circulation, and digital evidence. It is established that the integration of such technologies contributes to increasing the accessibility and efficiency of justice, ensures оператив communication between participants in criminal proceedings, and enhances the practical implementation of procedural rights.
At the same time, the study identifies a number of significant challenges related to digitalization, including the lack of a unified regulatory framework, insufficient legal regulation of electronic identification procedures, technical and infrastructural limitations, and risks to confidentiality and information security. It is emphasized that these issues directly affect the effectiveness of the victim’s representative in performing their procedural functions.
The author substantiates the need to reconsider the functional role of the victim’s representative in the context of digital transformation, viewing them as an active subject of digital legal activity who ensures the adaptation of the victim to new forms of procedural interaction. The article proposes directions for improving criminal procedural legislation in Ukraine, including the development of a comprehensive legal framework for electronic criminal proceedings, strengthening guarantees for the protection of participants’ rights, and introducing unified standards for digital procedural tools.
