DOCTRINAL APPROACHES TO UNDERSTANDING THE ADMINISTRATIVE-LEGAL REGULATION OF THE DEMOGRAPHIC SPHERE

Abstract

The article examines the administrative-legal doctrine of regulation of the demographic sphere as a holistic system of scientifically substantiated provisions, principles and categories that determine the content, boundaries and instruments of state influence on demographic processes. It is substantiated that in modern conditions the demographic sphere acquires the importance of one of the key objects of public administration, since it is associated not only with population reproduction, but also with ensuring national security, social stability, labor potential of the state and the implementation of fundamental human rights. This issue becomes particularly relevant in the conditions of post-war development of Ukraine, when the negative demographic consequences of armed aggression, mass migration, declining birth rates, deterioration of the health of the population, loss of human potential and deformation of the age structure of the population require systematic legal understanding and appropriate administrative-legal response.

It is determined that the administrative-legal doctrine of demographic regulation should be considered as a conceptual basis for the formation and implementation of state demographic policy, focused on combining public interest with the priority of human rights and freedoms. It is proven that such a doctrine encompasses a set of theoretical approaches to understanding the demographic sphere as an object of administrative-legal regulation, the principles of activity of public administration entities, administrative-legal means of influencing demographic processes, as well as the limits of permissible state intervention in the sphere of private and family life. Attention is focused on the fact that modern administrative-legal doctrine should be based on the principles of anthropocentrism, proportionality, legal certainty, social justice, intersectoral coordination and demographic sustainability. It is concluded that the formation of a holistic administrative-legal doctrine of demographic regulation is a necessary prerequisite for improving legislation, increasing the efficiency of public administration and developing a long-term model of demographic restoration of the state. Its practical significance lies in creating a scientific basis for updating the mechanisms of state influence on demographic processes in order to ensure demographic security, protect human rights and restore the demographic stability of Ukraine in the post-war period.
