IMPLEMENTATION OF INTERNATIONAL MECHANISMS OF ADMINISTRATIVE LIABILITY FOR VIOLATIONS OF ELECTORAL LEGISLATION

Abstract

The article examines and analyzes the main methods of conducting elections in foreign countries, as well as the possibility of implementing international mechanisms for administrative responsibility for violations of electoral legislation in the context of the digitalization of the electoral process and Ukraine's European integration. The problematic aspects of these issues include risks of cyber threats, digital inequality of access, and a low level of voter trust in electronic systems, which necessitates strengthening administrative sanctions to ensure transparency and fairness. It is emphasized that the current legislation, particularly the Code of Ukraine on Administrative Offenses, only provides for general fines for electoral violations. Such sanctions are insufficiently effective, considering corruption risks, the lack of specialized monitoring bodies, and weak adaptation to digital technologies.

The focus is on harmonizing Ukrainian electoral legislation with European standards in the context of Ukraine's Eurointegration. Based on the experience of countries (particularly Estonia) and recommendations from international organizations (Council of Europe, OSCE, International IDEA, Venice Commission), specific ways to improve national legislation are proposed. Among them are the introduction of proportional administrative sanctions, mandatory technical audits, automated monitoring of violations, and the implementation of pilot projects with hybrid voting systems.

The article offers a comprehensive concept for reforming administrative responsibility in the electoral sphere, aimed at balancing innovation, security, and adherence to international democratic standards. The proposed changes will contribute not only to increasing voter turnout and restoring trust in democratic institutions but also to effectively countering modern threats during the post-war reconstruction period of the state.
