THE CONCEPT, TYPES AND SIGNIFICANCE OF NORM-MAKING ACTIVITY IN THE FIELD OF ENSURING ENVIRONMENTAL SECURITY OF UKRAINE IN THE CONDITIONS OF EUROPEAN INTEGRATION

The article presents a comprehensive study of the concept and types of norm-making activity. An analysis is conducted of international legislation, legislative and subordinate normative legal acts of Ukraine, as well as the scholarly contributions of leading domestic and foreign researchers who have examined the particularities of norm-making activity in the field of environmental safety.
The purpose of the article is to define the concept of norm-making activity, classify its types, and substantiate its significance for ensuring environmental safety in contemporary Ukraine. It is argued that norm-making activity in the field of environmental safety constitutes a specialised form of law- making carried out by authorised subjects and aimed at the creation, amendment, and repeal of legal norms designed to ensure and maintain environmental safety in the state through guaranteeing the constitutional right of citizens to a safe natural environment, establishing environmental standards and norms, and providing for liability for violations of current legislation. It is noted that norm-making activity in the field of environmental safety is not homogeneous and may accordingly be divided into four principal types: international, legislative, subordinate, departmental, and local. Each of these types is characterised by a specific legal basis, a distinct range of subjects, and a particular mechanism of implementation. The significance of norm-making activity in the field of ensuring environmental safety in Ukraine is examined through the lens of its preventive, regulatory, informational, and European integration functions. It is established that the factors adversely affecting the effectiveness of norm- making activity in the environmental sphere under conditions of armed conflict in Ukraine include: the fragmentary nature of normative regulation of legal relations in the field of environmental safety; partial inconsistency between the provisions of subordinate and departmental normative legal acts and amendments introduced to Ukrainian legislation; the slow pace of implementation of European norms and standards into national legislation; and the obsolescence of certain environmental standards. Proposals are formulated for the improvement of norm-making activity in the field of environmental safety, including the systematisation of national legislation, the adoption of a unified legislative act, and the strengthening of the European integration dimension of the norm-making process in Ukraine.
