THE SUBJECT COMPOSITION OF THE ORGANIZED AGRARIAN MARKET

Abstract

organized agrarian market in legislation, while legal scholarship addresses this issue fragmentarily. The aim of the article is to provide a comprehensive characterization and definition of the subject composition of the organized agrarian market. The study employs a set of general scientific and special methods, including dialectical, analysis and synthesis, structural-functional, and formal-legal methods, which allowed for a thorough characterization of the subject composition of the organized agrarian market. The features of legal capacity of a subject of the organized agrarian market are identified: the ability to conclude and perform civil law contracts; engagement in activities related to the production and/or sale of agricultural products; participation in exchange trading; and the conclusion of contracts under standardized terms and requisites in accordance with the rules of the Agrarian Exchange. It is proposed to distinguish between supply-side participants in the organized agrarian market (including agricultural producers) and participants involved in the sale of agricultural products (responsible for product distribution and transfer of property rights in the organized agrarian market). The article compares the wholesale agricultural market and the agricultural commodity exchange, which allows concluding that these subjects differ in terms of organizational form, trading mechanisms, and legal status. It is established that each has specific functions and legal capacity within the organized agrarian market system. Furthermore, it is proposed to highlight a separate financial market segment within the organized agrarian market, which includes operators of organized trading platforms and mechanisms for trading agrarian financial instruments such as agrarian bills and agrarian notes. This approach clarifies the legal status of participants in the financial segment and ensures transparency and regulation of financial operations in the agrarian market. It is emphasised that the issue of the composition of participants in the organised agricultural market requires further academic research.

The subject composition of the organized agrarian market remains a topic requiring further scholarly research.
