ARTIFICIAL INTELLIGENCE AND COPYRIGHT: CURRENT CHALLENGES AND LEGAL REGULATION

. The article is devoted to the study of current issues related to the legal regulation of the use of artificial intelligence systems (hereinafter – AI) in the field of copyright law. In the context of the rapid development of digital technologies, artificial intelligence systems are increasingly used in the process of creating various results of creative activity, including texts, musical works, images, software and other objects of intellectual property. This process generates new legal challenges related to determining the legal status of such results, identifying the subject of copyright, and defining the limits of legal responsibility of participants in the relevant legal relations.
The article summarizes the theoretical foundations of legal regulation and analyzes the empirical basis concerning the application of artificial intelligence systems in scientific and creative activities. Modern scientific approaches to determining the legal status of intellectual products created with the use of machine learning algorithms are examined, as well as the possibility of their legal protection within the framework of current copyright legislation.
Particular attention is paid to the issues of legal protection of intellectual property objects generated with the use of artificial intelligence technologies, as well as to determining the scope of liability of developers, users and owners of such technologies. The regulatory framework for copyright protection provided by the provisions of the Civil Code of Ukraine and the Law of Ukraine “On Copyright and Related Rights” is analyzed, and a comparative analysis of international approaches to the legal regulation of the results of artificial intelligence activities is carried out.
The constitutional guarantees for the protection of intellectual rights in the broadest understanding of this legal institution have been analyzed, with particular attention focused on the specific features of assessing the personal contribution of a researcher to the results of their work created using artificial intelligence technologies.
The study substantiates the necessity of improving national legislation taking into account international standards and modern trends in the development of digital technologies. The author proposes directions for harmonizing legal regulation in the field of artificial intelligence with European approaches to the protection of intellectual property rights.
