REGULATORY AND LEGAL BASIS OF ORGANIZATION OF PUBLIC CONTROL IN TRANSPORT: QUESTIONS OF IMPROVEMENT

The article is devoted to the study of the regulatory and legal principles of organizing public control over compliance with transport legislation and identifying areas for its improvement. The relevance of the topic is justified by the need to ensure transportation safety, improve the quality of transport services, protect the rights of citizens and the environment, as well as harmonize Ukrainian transport legislation with European standards in the context of integration into the EU.
The current state of legal regulation of control activities in transport is analyzed. It is noted that the main norms are concentrated in the Law of Ukraine "On Transport", which defines only the general competence of executive authorities and local self-government bodies, but does not contain detailed provisions on subjects, forms, methods, procedures and mechanisms of public control. A number of significant shortcomings of the current legislation are identified: fragmentation and insufficient coordination of norms, lack of digital management mechanisms, environmental requirements for pollutant emissions, detailed infrastructure safety standards, effective protection of the rights of consumers of transport services.
The leading role of administrative and legal norms in regulating transport relations is emphasized through the consolidation of generally binding rules, the powers of regulatory authorities, the grounds for legal liability and ensuring traffic safety and environmental protection.
The proposals of scientists on improving the regulatory and legal principles of organizing public control in transport are considered. It is established that the creation of a single codified act is inappropriate due to the risk of duplication of norms, violation of the systematicity of legislation, increased bureaucracy and administrative burden on the country's law enforcement system.
