Abstract

the paper discusses the normative and legal regulation of the sphere of special technical means of removing information from communication channels and other technical means of covert obtaining information about their names and types.

The article discusses the main legislative and regulatory legal acts related to technical regulation, control over illegal trafficking and forensic examinations of special technical means of covert obtaining information. The authors drew attention to the concept and terms of special technical means of covert receipt of information, which are specified in DSTU 9249:2023 "Special technical means for removing information from communication channels and other technical means of covert obtaining information. Basic terms, definitions of concepts and classification".

The main problematic issues are presented both in the conceptual apparatus of special technical means of covert receipt of information from communication channels and other technical means of covert receipt of information, and in the list of their types. The term "means" in the names of types of special technical means of covert receipt of information and possible negative consequences of its misinterpretation are considered, the option of solving this problem is described.

The authors provide a classification of special technical means of covert receipt of information by functional purpose, which is brought in line with innovations in legislative acts. In addition, the above classification takes into account the trends in the development of scientific and technological progress, information technologies and the spread of their scope, as well as generalized the results of expert practice, which indicate the loss of their relevance of certain types of special technical means of covert obtaining information in operational-search, counterintelligence and intelligence activities.
