HISTORY OF LEGISLATIVE INITIATIVES ON LEGAL REGULATION OF FORENSIC EXAMINATION ACTIVITIES IN UKRAINE

Abstract

The article provides a comprehensive, systematic analysis of draft laws on the administrative and legal regulation of forensic activity in Ukraine. Legislative activity in this area is critical for ensuring justice and strengthening trust in the judicial system. The main attention is paid to the creation of a single terminological apparatus that would correspond to all branches of forensic expertise. Changes should be systemic and include legislative, scientific and methodological, information, financial and logistical support. It is necessary to take into account international experience and practices, the integration of modern technologies and e-government are important areas of reform. In particular, the introduction of electronic databases can significantly simplify the interaction between subjects of expert activity. The effectiveness of forensic activity can be increased by introducing comprehensive monitoring of the legislation regulating this area. It is also advisable to create mechanisms for rapid response to new challenges, for example, during military aggression.

Strategy for the Development of the Justice System and Constitutional Judiciary for 2021-2023: was approved by the Decree of the President of Ukraine dated 11.06.2021 No. 231/2021 [1].

The forensic expert reform was initiated by the Decree of the President of Ukraine No. 837/2019 dated November 8, 2019. According to the Decree, by the end of 2020, the Cabinet of Ministers of Ukraine was to prepare legislative amendments, in particular, the creation of a system of self- government of forensic experts, review of expert opinions, and determination of deadlines for conducting expert examinations.

This reform approach aims to improve the quality of forensic examination and compliance with international standards. After the adoption of the Law of Ukraine “On Forensic Examination” in 1994, a significant number of amendments and supplements were adopted, reflecting the constant development of legal regulation in this area.
