LAW ENFORCEMENT RELATIONS IN THE CONDITIONS OF MODERN SOCIO-POLITICAL TRANSFORMATIONS: CHARACTERISTICS, TENDENCIES, CHALLENGES

Abstract

The article is devoted to the study of the peculiarities of law enforcement and mechanisms for their implementation, taking into account the main trends of development and challenges facing the law enforcement system.

The study revealed that law enforcement relations are regulated by the rules of law, the social relations that arise between entities in the process of exercising the functions of law enforcement, human rights and freedoms, counteracting offenses and bringing those responsible for legal responsibility. The peculiarity of law enforcement is that most legal relations in this area arise on the basis of legal norms that are prohibitive and are aimed at preventing unlawful behavior.

The mechanism of implementation of law enforcement relations and its structural elements is determined. In particular, the mechanism of implementation of law enforcement relations is a complex system of interaction of legal norms, subjects, forms and methods of law enforcement, aimed at effectively ensuring the legality, law and order and protection of human and citizen's rights and freedoms. The key role in this process is played by state coercion, which is the main way to ensure the implementation of the law enforcement function of the state.

As a result of the study, the actual problems of law enforcement relations are identified, the transformation of legal mechanisms of safety, a change in approaches to law enforcement and the challenges of wartime.

Attention is emphasized on the prospects for the development of law enforcement in Ukraine. It is determined that only under the conditions of a comprehensive approach, coordinated political will and public participation, it is possible to effectively reform the system of law enforcement and the construction of a rule of law with a high level of law and order in institutions.
