Abstract

The article highlights the problematic issues of questioning a suspect during the investigation of criminal offenses committed with the use of computer information technologies. It is noted that the effective and timely conduct of certain investigative (search) actions contributes to the comprehensive and complete investigation of criminal offenses committed with the use of information computer technologies (cybercrimes). One of the main investigative (search) actions, which has significant procedural and tactical significance during the investigation of criminal offenses committed with the use of information and computer technologies, is the interrogation of a suspect.

It was emphasized that the investigator, inquirer, and prosecutor do not always have sufficient knowledge in the field of information technologies. Therefore, it is necessary to consult with a specialist before conducting an interrogation. This will make it possible to outline the most important questions for the suspect and help in establishing the technical nuances of the criminal offense under investigation.

It is noted that during the interrogation of a suspect in criminal proceedings regarding cybercrimes, the following tactical techniques may be used: exposure of lies, emotional influence, logical influence, as well as certain tactical combinations. The application of the above tactics depends on the corresponding investigated criminal offense of the specified category.

Attention is drawn to the study by the pre-trial investigation bodies and the prosecutor of the practice of the European Court of Human Rights regarding the questioning of suspects. The analysis of such decisions will help to ensure compliance with the rights and legitimate interests of the suspect, as well as ensure a full and impartial investigation of the specified criminal offenses.
