Abstract

The article highlights the key issues of the peculiarities of legal registration of labor relations during martial law in Ukraine. Practical approaches and problems regarding the execution of an employment contract at a distance are studied. The provisions of the Code of Labor Laws and the Law of Ukraine "On the Organization of Labor Relations in the Conditions of Martial Law", as well as judicial practice on the enforcement of provisions on the use of electronic communications between an employee and an employer, are analyzed. Attention is focused on the need to strengthen the algorithm for drawing up an employment contract using electronic communication. Emphasis is placed on the importance of using electronic communication in the formalization of labor relations. The main stages of concluding an employment contract are determined, namely the issue of accepting documents, familiarizing the person who is employed with the working conditions, writing an application by the employee and issuing an order to hire the employee through the use of electronic communication. The question of the possibility of using Viber correspondence as evidence in the case of a labor dispute in court is under consideration. Also, the peculiarity of submitting a Notice of hiring an employee by the owner of an enterprise, institution, organization or an authorized body (person) or natural person to the territorial bodies of the State Fiscal Service at the place of registration of their payer of the single contribution to the mandatory state social insurance on paper is also being investigated.
