ЦИВІЛЬНО-ПРАВОВЕ РЕГУЛЮВАННЯ ОСОБИСТОГО СТРАХУВАННЯ

Abstract

The scientific article is a comprehensive and independent study of the personal insurance procedure in the current legislation of Ukraine, in particular in the field of civil legal relations. Based on the analysis of literary sources of recent years and other authoritative publications, methodological recommendations, monographs, scientific interpretations and additions to the legislation of Ukraine, norms of current civil legislation and the practice of its application, the research reveals the concept, essence and characteristic features of personal insurance.

The study characterized the main types of personal insurance. Basic statistical data on distribution are given insurance in the country. The main trends in the development of personal insurance in Ukraine are presented, the concept of personal insurance legal relations, the debatable issues of defining the elements of personal insurance legal relations, the concept, signs and content of a personal insurance contract as the basis for the emergence of personal insurance legal relations, as well as the legislative requirements for its conclusion, specific features of mandatory personal insurance and the grounds for the emergence of legal relations of mandatory personal insurance, the procedure for the implementation of personal insurance obligations, as well as the practice of Ukrainian courts of various instances in resolving disputes between participants in insurance legal relations.

The result of such research was the formulation of a number of scientific conclusions, proposals for improving the current procedure of personal insurance, which are the result of fruitful work with scientific literature.
