ПИТАННЯ МУЛЬТИКУЛЬТУРАЛІЗМУ В НАЦІОНАЛЬНОМУ ПРАВІ

Abstract

The multicultural nature of modern societies due to the processes of globalization and integration is evidence not only of growing respect for the principles of equality and tolerance in the interaction of different sociocultural groups, but also exacerbation of interethnic conflicts and confrontations between two modern trends, namely national identification and cultural unification. It is the latter fact that requires a deep theoretical understanding of the realities of multiculturalism in the modern world.

In the Ukrainian scientific discourse, the phenomenon of multiculturalism is one that is actively discussed since the beginning of the XXI century, although it has not acquired an unambiguous description. The need for a detailed and in-depth study of the achievements of European models of multiculturalism is the most appropriate for their use in modern polyethnic Ukraine in order to develop optimal strategies and tactics for building a truly democratic society. A society that perceives multiculturalism as a political and ideological doctrine that ensures social integration, as it creates a comfortable cultural environment and a sense of state for all ethnic, cultural and religious groups. Discussions should focus not only on international human rights standards, but also on effective mechanisms for their implementation at the level of national governments, as well as on the timely implementation of international law in national legislation.

Each state must determine for itself how much non-standard political and cultural rights it can and must provide to communities and their representatives who have difficulty adapting or upholding the principles of “alternative” identity. In developing an appropriate strategy for the group interests of ethnic and religious communities, it should take care of the entire system of mechanisms that will ensure its implementation.
