It is now worth focusing on a fairly broad definition of the first democratic principle. Indeed, the concept of "equality of all citizens" in the content of public administration is quite subjective and depends on many factors, ranging from the characteristics of the citizens themselves (possibly incapacitated or those who do not meet the special requirements of the candidate, etc.) and ending with the vision criteria of equality and monitors its observance. In order for the observance of the principle of equality to exist non-nominally, it is necessary to clearly define the essence and limits of such equality. There are two aspects to this question.
The first aspect is that it is impossible to recognize all citizens of Ukraine as absolutely equal in the types, scope and methods of exercising the established rights in the sphere of public administration. Since the state is created to serve the interests of all citizens, the establishment of balanced restrictions on the exercise of human rights and freedoms will ensure the interests of society as a whole. The main thing is this: given the actual inequality of citizens in the field of public administration, democracy will be that every citizen is endowed not with all existing rights, but with a part of personalized (depending on personal characteristics) rights sufficient to protect their rights and legitimate rights. interests in relations with state authorities.
In the article the concept ‘Personnel Management’, the principle of legitimacy, the HR-technologies in the state service, tools and methods of staff development, personell management technologies in the of civil service have been analysed. The analysis of legal base in Ukraine for governing the selection of personnel, motivation, adaptation, training and professional development, career development, personnel reserve formation has been conducted. It is defined the procedures, technologies, mechanisms that are used in the management of state service personnel without being determined by current laws of Ukraine. The ways of solving the problems of the legitimacy principle in the management of civil service personnel.
